According to Bloomberg News, a state court jury in Delaware found that Boston Scientific’s Pinnacle and Advantage Fit inserts were defectively designed, and that executives in the company hid the flaws from the patient. Additionally, according to Bloomberg, the jurors also found Boston Scientific engaged in fraud due to their failure in alerting doctors of the faulty devices’ design.
According to an article in Reuters, Boston Scientific still faces over 25,000 mesh claims in federal and state courts throughout the U.S. Thousands of claims against Boston Scientific are still pending, and they’ve been consolidated into multidistrict litigation (MDL) under U.S. District Judge Joseph Goodwin in the Southern District of West Virginia (Boston Scientific MDL 2326).
